  1.  Selection and Identification: Choose the firearm you want to purchase from a Federal Firearm Licensee (FFL) or a licensed gun dealer. At the same time, you'll need to present a valid government-issued photo ID.
  2. Filling out Documentation: The dealer will give you the ATF Form 4473, also known as the Firearms Transaction Record. You'll fill out this form with your personal information and answer questions about your eligibility to own a firearm.
  3. Conducting the Background Check: Your filled-out form will be used by the FFL to conduct a background check through the Firearm Purchase Program, managed by the Florida Department of Law Enforcement (FDLE). The check is meant to look for any criminal records or other disqualifiers that would make it illegal for you to own a gun.
  4. Obtaining a Queue Number: Assuming your background check is cleared, the FDLE will then give out a transaction number - also known as a queue number. This unique number is tied to your particular background check and will be noted down on the ATF Form 4473 by the dealer.
  5. Completing the Purchase: Once all the checks are done and everything is in order, you can finalize your purchase. The dealer will hand over the firearm to you, and you should take steps to store and transport it safely.


Both the Firearm Purchase Program (FPP) and the FBI's National Instant Criminal Background Check System (NICS) are designed to comply with the requirements set forth by the Brady Handgun Violence Prevention Act of 1993. This involves conducting background checks on individuals intending to acquire firearms from Federal Firearm Licensees (FFLs), commonly known as licensed gun dealers.


In Florida, the FPP functions as the primary interface for conducting these background checks when transactions involve FFLs. There's a single exception to this, which applies to pawnbrokers. If they're conducting a background check for a pawn redemption that occurs within a 90-day window from the date of pawn, they may opt to use the FBI's NICS system instead.


What sets the FPP apart is that it not only checks federal databases like the FBI's NICS does but also state-level databases. As a result, the outcome of the background checks performed by the FPP may differ from those carried out solely through the FBI's system.


Under federal law (Title 18, United States Code 922(g)(1)-(9), (n)), there are ten categories of individuals who are disqualified from purchasing or possessing firearms. These categories include:

  1. Individuals with felony convictions or equivalent offenses.
  2. Fugitives from justice.
  3. Individuals who unlawfully use or are addicted to controlled substances.
  4. Persons deemed mentally unfit or involuntarily committed to treatment.
  5. Illegal aliens.
  6. Individuals with a dishonorable discharge from the U.S. Armed Forces.
  7. Persons who have renounced their U.S. citizenship.
  8. Individuals subject to active protection orders (e.g., restraining orders, injunctions for protection).
  9. Individuals convicted of a misdemeanor crime of domestic violence.
  10. Individuals under indictment or charged with a felony.


In addition to these federal regulations, Florida state law prohibits the following persons from purchasing or possessing firearms:

  1. Those adjudicated delinquent for an offense that would be considered a felony if committed by an adult, until the age of 24 or until the record is expunged.
  2. Individuals who received "Adjudication Withheld" on any felony or misdemeanor crime of domestic violence and have not yet completed three years since the fulfillment of their sentencing provisions.
  3. Those recently arrested for a potentially disqualifying crime that has not been dismissed or disposed of in court.


To purchase a firearm in Florida, the following requirements apply:

  1. The purchaser must be at least 21 years old. However, law enforcement officers, correctional officers (as defined in F.S. 943.10), or service members (as defined in F.S. 250.01) can purchase rifles and shotguns at the age of 18.
  2. For the purchase of a handgun, one must be a Florida resident. However, long guns can be bought by residents of other states, given the sale abides by the laws in the purchaser’s home state.
  3. Legal permanent residents of Florida who are aliens can purchase a firearm, provided they present a valid alien registration number. Non-resident aliens in Florida must present a border crossing number (I-94) and a valid exception document.
  4. Florida does not require a permit to purchase a firearm, nor is there a permit that would exempt anyone from the background check requirement.
  5. There is a mandatory waiting period of three days, excluding weekends and state holidays, between the purchase and delivery of all firearms. Local counties and cities have the power to extend this waiting period to up to five days. Please consult local ordinances for more information.
  6. There is no limit to the number of firearms that can be transferred in a single transaction. A transaction is considered complete once the ATF Form 4473 is completed and signed by the dealer. If there's an additional transfer later, another background check is required.
